General Terms and Conditions for Artwork Submission –

  1. Purpose

    These general terms and conditions govern the submission of artworks by artists on the Art4Fen platform. By submitting an artwork, the artist fully and unreservedly accepts the following terms.

    Fees and Payment

    Registration on Art4Fen is free of charge.

    In the event of a sale, Art4Fen charges a commission on the final sale price. The applicable commission rate is specified when the artist accepts the charter and collaboration agreement.

    Artist payments are made within 15 working days following confirmation that the buyer has received the artwork.

    Shipping costs are the responsibility of the buyer, unless otherwise stated.

    Artist Commitment

    The artist guarantees that they are the author of the submitted artwork and that they hold all related usage and reproduction rights.

    Any fraudulent submission, or any artwork that does not comply with the platform’s artistic guidelines, may be removed without prior notice.

    The artist accepts the selection and validation criteria established by the Art4Fen artistic committee.

    Termination and Cancellation

    The artist may withdraw their artwork from the platform at any time, provided that the artwork is not currently involved in a transaction.

    In the event of a breach of obligations, including non-delivery, poor quality, misleading information, or illegal content, Art4Fen reserves the right to terminate the agreement unilaterally.

    Liability and Indemnification

    The artist remains fully responsible for the content published and for the quality, authenticity, and shipment of the artworks.

    In the event of a dispute or third-party claim, including copyright infringement, counterfeiting, delivery issues, or any other legal claim, the artist agrees to indemnify Art4Fen for any damages, costs, expenses, or penalties incurred.

    Applicable Law and Jurisdiction

    These terms are governed by French law. In the event of a dispute, the parties shall first attempt to reach an amicable resolution. Failing that, the competent courts of Paris shall have exclusive jurisdiction.


    General Terms and Conditions of Purchase

    Purpose

    These terms apply to any purchase made on the Art4Fen platform, including original artworks, reproductions, digital works, or downloadable files.

    Purchase Process

    The buyer selects an artwork and makes a secure payment using the payment methods available on the website.

    After payment, the buyer receives an order confirmation email and, where applicable, delivery tracking information.

    Prices and Fees

    Prices are displayed in euros, including applicable taxes.

    Shipping fees may be added to the artwork price.

    Any customs duties, import fees, or local taxes are the responsibility of the buyer.

    Delivery

    Artworks are shipped directly by the artist or through Art4Fen’s logistics services within 7 to 15 working days.

    In case of non-receipt, the buyer may submit a claim through Art4Fen’s customer service within 15 days of the order date.

    Withdrawal and Return

    In accordance with applicable legislation, the buyer has a 14-day right of withdrawal, except for:

    • digital files that have already been downloaded;
    • personalized or custom-made artworks.

    Return shipping costs are borne by the buyer, except in the case of an error by the platform.

    Authenticity and Ownership

    Each artwork is accompanied by a certificate of authenticity provided by the artist.

    The purchase of an artwork does not entail any transfer of copyright, unless explicitly stated in writing.

    Liability

    Art4Fen acts as an intermediary platform and cannot be held liable for losses or damages caused by errors attributable to the artist, the buyer, or the carrier.

    In the event of a dispute, Art4Fen customer service may attempt to act as a mediator between the parties.
